If you are pulled over on suspicion of DUI, the law requires the submission of either a blood, breath or urine test. Failure to do so will result in an automatic minimum one year suspension of your driver’s license. In addition to a criminal court case, you will also be required to attend a DMV Administrative Hearing.

A first offense will typically result in extensive fines, the loss of your driver license, mandatory attendance at DUI school, and jail time for a first offense.

A second offense will result in a mandatory jail sentence ranging from 10 days to 1 year, increased fines, and mandatory attendance at DUI school for up to a year and a half.

A third conviction requires at least six months in jail as well as a full year and a half in DUI school. Upon a fourth conviction, the District Attorney can bring Felony DUI charges as well as 3 years of incarceration in state prison.

Extenuating circumstances such as injury or death of another will lead to an enhanced sentence and possible felony DUI charge, even if the defendant has no prior DUIs on their record.
